Privacy Policy

I. Basic Provisions

  1. The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, hereinafter referred to as the “GDPR”, is:

  1. Personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to a specific identifier, such as a name, identification number, location data, network identifier, or by reference to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

  2. The controller has not appointed a Data Protection Officer.


II. Sources and Categories of Personal Data Processed

  1. The controller processes personal data that you have provided to the controller, or personal data that the controller has obtained on the basis of fulfilling your order.

  2. The controller processes your identification and contact details and data necessary for the performance of the contract.


III. Legal Basis and Purpose of Personal Data Processing

  1. The legal basis for processing personal data is:

    a) the performance of a contract between you and the controller pursuant to Article 6(1)(b) GDPR;

    b) the legitimate interest of the controller in providing direct marketing, especially for sending commercial communications and newsletters, pursuant to Article 6(1)(f) GDPR;

    c) your consent to processing for the purpose of providing direct marketing, especially for sending commercial communications and newsletters, pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in cases where no order for goods or services has been placed.

  2. The purpose of personal data processing is:

    a) processing your order and exercising the rights and obligations arising from the contractual relationship between you and the controller. When placing an order, personal data necessary for the successful processing of the order is required, especially name, address and contact details. Providing personal data is a necessary requirement for concluding and performing the contract. Without providing personal data, it is not possible to conclude or perform the contract on the part of the controller;

    b) sending commercial communications and carrying out other marketing activities.

  3. The controller does not carry out automated individual decision-making within the meaning of Article 22 GDPR. You have provided your explicit consent to such processing.


IV. Data Retention Period

  1. The controller retains personal data:

    a) for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims arising from these contractual relationships;

    b) until consent to the processing of personal data for marketing purposes is withdrawn.

  2. After the expiry of the personal data retention period, the controller shall delete the personal data.


V. Recipients of Personal Data

  1. Recipients of personal data are persons:

    a) involved in the delivery of goods, provision of services or execution of payments on the basis of the contract;

    b) providing e-shop operation services and other services related to the operation of the e-shop;

    c) providing marketing services.

  2. The controller does not intend to transfer personal data to a third country, meaning a country outside the European Union, or to an international organisation.

  3. Services used for marketing and support purposes include:

    • Google Analytics – records cookies and website usage;

    • Google Ads – records cookies and website usage;

    • Google Shopping – review request, records e-mail address if you consent during the order process;

    • Heureka – records purchase conversions and e-mail address for the “Verified by Customers” service;

    • Zboží.cz – records purchase conversions and e-mail address;

    • Sklik – records cookies, website usage and purchase conversions.


VI. Your Rights

  1. Under the conditions set out in the GDPR, you have:

    a) the right of access to your personal data pursuant to Article 15 GDPR;

    b) the right to rectification of personal data pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR;

    c) the right to erasure of personal data pursuant to Article 17 GDPR;

    d) the right to object to processing pursuant to Article 21 GDPR;

    e) the right to data portability pursuant to Article 20 GDPR;

    f) the right to withdraw consent to processing in writing or electronically at the address or e-mail address of the controller stated in Article III of this Policy. You may withdraw your consent at any time in your own customer account.

  2. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.


VII. Conditions for Personal Data Security

  1. The controller declares that it has adopted all appropriate technical and organisational measures to secure personal data.

  2. The controller has adopted technical measures to secure data repositories and repositories of personal data in paper form, in particular secured/encrypted access to the website, encryption of customer passwords in the database, regular system updates and regular system backups.

  3. The controller declares that only persons authorised by the controller have access to personal data.


VIII. Final Provisions

  1. By submitting an order through the online order form, you confirm that you have read this Privacy Policy and accept it in full.

  2. You agree to this Policy by ticking the consent checkbox in the online form. By ticking the consent checkbox, you confirm that you have read this Privacy Policy and accept it in full.

  3. The controller is entitled to amend this Policy. The new version of the Privacy Policy will be published on the controller’s website, and the controller will also send the new version of this Policy to the e-mail address you provided to the controller.

This Privacy Policy is valid from 1 November 2023.
